Certain personal data may be required for the services that Neverdark offers. Below you will find an overview of which personal data can be collected by Neverdark:

  • Name and address details;
  • E-mail address;
  • payment details;
  • Sex.

No special personal data is collected by Neverdark.

Consequences of not providing personal data

You are of course not (legally) obliged to provide us with your personal data. However, if you do not provide the (required) personal data, some of our services cannot be performed by Neverdark for/on your behalf.

For what purposes personal data is collected

Personal data is not simply collected. This always happens for a reason. Below you will find an overview of the purposes for which Neverdark may collect (your) personal data:

  • Filling in a contact form;
  • Creating an account;
  • Registering for a newsletter;
  • Handling orders;
  • Contacting you;
  • Executing the agreement;
  • Claiming performance of an agreement with us;
  • Verifying that you say who you are when exercising your rights under privacy law.

There is no automated decision-making based on certain personal data.

On what grounds personal data is collected

The law prescribes that if personal data is processed, this must be done on a legal basis. Neverdark processes personal data on the following grounds:

  • It is necessary for the performance of our services;
  • You have given permission for the processing;
  • Neverdark has a legitimate interest in processing your personal data;
  • You have disclosed the personal data yourself without being obliged to do so.

Sometimes we have a legitimate interest in processing your personal data.

Marketing

If you purchase a service from us, we can approach you with an offer of similar products or services after providing the service. In this way Neverdark can grow and increase its brand awareness. The use of your personal data is limited in this case. In addition, you always have the right to opt-out of such marketing.

Receivables

We may use your personal data to detect fraud or fraud, to report it, to hand over a claim or to conduct a lawsuit. In that case, we may need certain data, such as name and address details, to initiate these processes. Cookies are small text files that are placed on your computer via your browser. Neverdark uses functional and technical cookies for the proper and user-friendly functioning of our website. No personal data is stored in these types of cookies. No permission is therefore required for this.

In addition, we use session cookies. With these cookies we see which parts you have visited during your visit (session) to our website. These cookies are automatically deleted as soon as you leave our site.

If Neverdark uses other types of cookies that do store personal data, we will always first ask for your explicit permission when visiting our website.

No cookies from other parties are placed on our website, including advertisers, for example.

Neverdark does keep statistics. Statistics are kept on our website via Google Analytics. With regard to Google Analytics, we have set the settings in accordance with the instructions of the Dutch Data Protection Authority.

Videos are posted on our website. These are:

  • Homemade videos and/or;
  • Videos made by our partners and/or;
  • A YouTube video and/or;
  • A Vimeo Video.

When we post a YouTube video on our site, we have enabled the privacy mode via YouTube. This means that YouTube does not record any of your personal data unless you choose to play the video.

Vimeo does not use tracking or advertising cookies. Vimeo only uses essential cookies for the video player to function properly.

Social media & Website

There are social media buttons on the Neverdark website. By using this Social media, you may share your data with the relevant social media and cookies may be placed by this party in your browser.

If you post a comment, review or the like on the social media pages of Neverdark, your name and possibly your (profile) photo will only be published as soon as you choose to post something. It is not possible to anonymize your data on our social media pages. The data published online is also included in the search engine results.

If you want to know what these third parties do with your data, it is advisable to read their privacy policy. This can usually be found on their own website. Some of these parties store this data in the United States.

Offers at Neverdark

We would like to keep you informed of our offers and the arrival of new products via:

  • Our webshop;
  • Through our Social Media pages;
  • Via our newsletter (<>) for which you can subscribe and unsubscribe.

Share with third parties

Neverdark shares your personal data with various third parties, provided this is necessary for the execution of the agreement and to comply with any legal obligation. These third parties are in any case:

  • The external hosting party that has the website on its server;
  • The bank relationship/payment system;
  • The party that takes care of our administration;
  • The third parties that we hire for the execution of the agreement;
  • The party that we may use to collect a claim.

The third parties referred to above are located within the EU. These third parties are not allowed to use your personal data for their own purposes, including marketing, acquisition, etc.

Neverdark does not sell your data to third parties.

Retention periods

Data is kept for as long as is necessary to provide Neverdark’s services. After the end of the service, your personal data will be stored for another six (6) months.

An exception to the above-mentioned retention period is invoice data (administration), after all, there is a legal obligation to keep this data for seven (7) years.

When personal data is collected on the basis of your consent, the personal data will be stored for a maximum of one (1) month after you have withdrawn your consent.

Security website and webshop

Neverdark keeps the website and its webshop as safe as possible. Your connection to the website is encrypted using SSL (secure sockets layer). In addition, the website and the webshop are well maintained and regularly scanned for vulnerabilities to ensure good security.

Your rights

You have the right to view, modify or delete your personal data. In addition, you have the right to restrict the processing of your personal data, to have it transferred to you and/or a third party and to object to the processing of personal data by Neverdark.

You can exercise your rights by contacting Neverdark by phone, email or post. The contact details are at the top of this privacy statement. We request that you enclose a copy of your proof of identity, so that we can determine that we are providing the requested information to the correct person. On the copy of your proof of identity, we ask you to make your passport photo, machine-readable zone and BSN number illegible.

Withdraw permission

When your personal data is processed on the basis of your consent, you always have the right to withdraw this consent by contacting Neverdark. The processing of these personal data will then be stopped. However, the withdrawal of consent has no retroactive effect.
